Rape as War Campaign

Rape, enforced pregnancy and sexual assault were not a mere by-product of the war and genocide directed at Bosnia & Herzegovina and its citizens, but rather a part of the overall campaign.

The International Criminal Tribunal for the former Yugoslavia (ICTY or "Yugoslav War Crimes Tribunal") established the legal precedent in how such offenses were to be treated by future international criminal tribunals. During the Rome Conference in 1998 creating the International Criminal Court, the experience of Bosnia & Herzegovina and particularly its women/girl victims (some men were also abused) provided a foundation for us to incorporate gender based crimes into the fabric of the Statue, including as a crime against humanity.
