Complementarity & Jurisdiction Exercised by the ICC

The International Criminal Court has as its key foundation, "universal jurisdiction," but exercised "complementary" to national courts. While many states have signed and ratified the Rome Statute, a lot less have adapted their domestic legislation consistent with their treaty obligations. Whether to exercise ICC jurisdiction in lieu of national courts will have to be decided on case by case basis, the evidence of states' commitments to the Rome Statue and its principles perhaps should be considered by Assembly of State Parties as a critical factor or at least to accord states and their judicial systems the benefit of the doubt.
